Regulatory Breach Issue 15

In this edition we continue to look at areas of environmental law with an interesting article on the Waste Batteries and Accumulators
Regulations 2009 which bring increased obligations on businesses involved in the use, production, supply and disposal of battery
powered products. We also look at interesting cases on abuse of process in environment and trades descriptions cases.

Our continued interest in Carbon law has resulted in consideration of the Carbon Reduction Commitment which comes into effect in the new year and a new look at Biofuels and the possible production of fuel from Algae. We welcome our new pupil Adam Beaumont to chambers. He has contributed an article on recent legal developments in preparation for Carbon Capture and Storage, which are of continued interest.

We also welcome contributions from new partners Megan Thomas and Azhar Rana of Littlejohn which look at the subjects of
re-use of Soil by demolition contractors and the Payment Services Regulations, important new regulations which affect all businesses engaged in money remittance and the provision of payday loans. Dan Stowers, a partner in the Regulatory and Criminal Investigations Group at Irwin Mitchell, discusses HM Revenue and Custom’s New Disclosure Opportunity.

Regulatory Breach issue 14 is now availble to view online.

In this edition we take a close look at the important House of Lords decision in Re B (Children) 2008 which has reconsidered the ‘sliding scale’ approach to the burden of proof that courts and tribunals have exercised in disciplinary cases for a number of years. We also look at the problem of Data Sharing under the Data Protection Act. Consumers are often ‘fobbed off’ by companies refusing to disclose information because of ‘Data Protection’. Guidance is given to a proper approach to data sharing, which involves a common sense and documented policy. Chambers continues to prosecute cases for FACT where publicans show live matches without paying the correct fees to Sky. The practical effects of prosecution upon a landlord are considered in an article which sets out the further effects of prosecution, which are often overlooked by publicans who do not understand the risks. We also continue to look at environmental issues, with particular interest in the growing market for Carbon Compliance and Offshore Wind Farm development. We look at the new Carbon Trust Standard, designed to help companies with their compliance and labelling. The recent budget has seen a massive boost for CCS technologies, which we will continue to consider in future editions.
